Say What???? Roof Top Antennas Prohibited?

I can't believe this?  In another post people are saying that in subdivisions people cannot put up a Rooftop antenna???

Where are my rights to this?

If I owned the house and the property that my house is on I should be able to have that right!

Lot's of developments have land covenents against these items ect......anytime you buy a house you have to check.

The Law

Our subdivision as those sort of things.  Anything that changes the visual "attraction" must be approved - i.e. baskeball hoops (allowed if fixed w/a pole - but not portable or garage/roof mounted), fences, antennae, cars on blocks, caravans, etc.

Other things, hvac equip can't be visible from the road and the paint job on the house can't be flourescant orange.  Can't have a car parked in the driveway for more than 2 weeks.  I knew this going in...it's a nice neighbourhood with no eye sores - no overhead electrical/phone cabling, etc.

btw - little sat. dishes are allowed.  :)

Now, some may cry "Where are my rights to this?" ( :) ) but, I beg to differ.  My last place had a junk man that stored rusty washers and fridges along his rickety fence and had 4-5 cars in his driveway in various states of disrepair.  My other neighbour and a busted up aerial and the other always had trash.  So I *choose* to live in an area that does not condone this.

Consequently, I lose a little - but...I can read the covenant before I buy.

So...if you want a bloody great tower - check if you can before you move.

I believe the FCC has ruled that you cannot prohibit outdoor antennas if that is what is needed to get a "good" picture. I've seen extensive discussions on what constitutes good. The rationale is to allow access to free broadcast television for all without local associations going overboard to prevent visual conformity.  Check the FCC site, its all there. Problem is that you would need to litigate this, and even if you prevail, it may cost $$.

I believe you are correct.  They'll first try indoor/attic one's first.  Also, convenant rules can be bent/broken due to logical reasons as well.  For example, if the subdivision requires builders to build the garage so the door does not face the street (makes the houses look bigger/nicer), but the lot does not allow this due to reasons I'm too dumb to know, then the garage faces the street.

Be advised, though, the "good" is subjective and may not include HiDef capabilities (though I'm not sure on the latter).
